Heartlog Terms of Service

1. Acceptance of Terms

By creating an account or using Heartlog ("the App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, please do not use the App.

2. Eligibility

You must be at least 18 years old to use Heartlog. By using the App, you represent and warrant that you meet this age requirement and have the legal capacity to enter into these Terms.

3. Account Responsibilities

You are responsible for:

• Maintaining the confidentiality of your account credentials.
• All activities that occur under your account.
• Providing accurate and truthful information when creating your account.
• Notifying us immediately of any unauthorized use of your account.

4. Acceptable Use

You agree NOT to use Heartlog to:

• Violate any applicable laws or regulations.
• Harass, abuse, or harm another person.
• Upload or share content that is unlawful, harmful, threatening, defamatory, or otherwise objectionable.
• Impersonate any person or entity.
• Attempt to gain unauthorized access to any part of the App or its systems.
• Use the App for any commercial purposes without our express consent.
• Interfere with or disrupt the App's functionality.

5. User Content

You retain ownership of all content you create within Heartlog (journal entries, notes, etc.). By using the App, you grant us a limited license to store and process your content solely to provide the App's services to you.

You are solely responsible for the content you create and store in the App. We do not monitor or review user content unless required by law or to investigate reported violations.

6. AI Features

Heartlog includes AI-powered features (such as Amie) that use third-party services to generate responses. By using these features:

• You acknowledge that AI responses are generated automatically and may not always be accurate or appropriate.
• You understand that your inputs may be processed by third-party AI providers (such as OpenAI) as described in our Privacy Policy.
• You agree not to rely on AI responses for critical decisions regarding relationships, health, legal matters, or other important life decisions.
• Fair Use Policy: To ensure a high-quality experience for all users and to prevent abuse, AI features are subject to usage limits. We reserve the right to temporarily suspend or limit access to AI features if your usage is determined to be excessive or non-human, even for subscribers of "Unlimited" tiers.

7. Subscriptions and Payments

Heartlog offers premium features through a monthly subscription ("Subscription").

• Payment will be charged to your Apple ID account at the confirmation of purchase.
• The Subscription automatically renews unless it is canceled at least 24 hours before the end of the current period.
• Your account will be charged for renewal within 24 hours prior to the end of the current period.
• You can manage and cancel your subscriptions by going to your account settings on the App Store after purchase.
• Subscriptions are non-refundable, except as required by Apple's refund policy or applicable law.

8. Intellectual Property

The App, including its design, features, code, and branding, is owned by Heartlog and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the App without our express permission.

9. Disclaimer of Warranties

HEARTLOG IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. WE DO NOT GUARANTEE THAT THE APP WILL BE ERROR-FREE, UNINTERRUPTED, OR SECURE.

Heartlog is a personal journaling and reflection tool. It is not a substitute for professional advice, including but not limited to relationship counseling, mental health services, or legal advice.

10. Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, HEARTLOG AND ITS AFFILIATES SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE APP.

Our total liability for any claims related to the App shall not exceed the amount you paid us (if any) in the 12 months preceding the claim.

11. Account Termination

You may delete your account at any time through the App settings. We reserve the right to suspend or terminate your account if you violate these Terms or engage in conduct that we determine is harmful to other users or the App.

12. Changes to Terms

We may update these Terms from time to time. We will notify you of material changes through the App or via email. Your continued use of the App after changes are posted constitutes acceptance of the updated Terms.

13. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which Heartlog operates, without regard to conflict of law principles.
