Terms of Service

These Terms of Service (“Terms”) govern your use of the Changeover mobile application (“the App”) published by Trevor Nogues (“we,” “us”). By downloading or using the App, you agree to these Terms. If you do not agree, do not use the App.

The product

Changeover is a personal tennis journal for logging matches, practices, casual hits, and equipment. Optional premium features (“Changeover AI”) provide narrative insights and question answering based on history you have logged. See the Privacy Policy for how data is handled.

Eligibility

You must be able to enter a binding agreement under the laws of your jurisdiction. The App is not intended for children under 13.

License

We grant you a personal, non-exclusive, non-transferable, revocable license to use the App for your own non-commercial tennis journaling, subject to these Terms and Apple’s App Store terms.

Your content

You retain ownership of the journal entries and notes you create. You are responsible for what you log. Do not include content that is unlawful, infringing, or that you do not have the right to process — especially if you use Changeover AI, which transmits a sanitized snapshot for analysis as described in the Privacy Policy.

Purchases and subscriptions

• The base App may be sold as a paid download through the App Store.
• Changeover AI is an optional auto-renewable subscription (currently offered as a yearly plan). Price and billing period are shown in the App and in App Store Connect at the time of purchase.
• Payment is charged to your Apple ID. Subscriptions renew unless cancelled at least 24 hours before the end of the current period, according to Apple’s rules.
• Manage or cancel in Settings → Apple ID → Subscriptions (or the equivalent on your device).
• Refunds are handled by Apple under Apple’s refund policies.

Changeover AI

AI output is generated from your logged history and is for personal reflection only. It is not professional coaching, medical, or legal advice. Insights may be incomplete, wrong, or outdated relative to your real game. You decide how (or whether) to act on them. Usage may be rate-limited. Features require a network connection when generating new results; cached results may appear offline.

Acceptable use

You agree not to:

• reverse engineer, scrape, or abuse the App or its backend beyond normal use;
• attempt to bypass subscription, entitlement, or rate limits;
• use the App to harm others or violate applicable law.

Third-party services

The App relies on third parties for distribution and, when AI is used, processing — including Apple, RevenueCat, Google Firebase, and OpenAI — each under their own terms. We are not responsible for those services’ availability or policies beyond our contractual control.

Disclaimer of warranties

The App is provided “as is” and “as available” without warranties of any kind, express or implied, including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the App or AI features will be uninterrupted, error-free, or meet your expectations.

Limitation of liability

To the maximum extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the App. Our total liability for any claim relating to the App is limited to the greater of (a) the amounts you paid us for the App or subscription in the twelve months before the claim or (b) USD $50. Some jurisdictions do not allow certain limitations; in those places, our liability is limited to the fullest extent allowed.

Termination

You may stop using the App at any time by deleting it and cancelling any subscription. We may suspend or stop providing features (including AI) if required for security, legal, or operational reasons, or if you violate these Terms.

Changes

We may update these Terms. The effective date above will change when we do. Continued use after an update constitutes acceptance. Material changes may also be noted on the App Store listing or in-app where practical.

Governing law

These Terms are governed by the laws of the State of California, USA, excluding conflict-of-law rules, unless mandatory consumer protections in your place of residence provide otherwise.

Apple-required notice

You acknowledge that these Terms are between you and Trevor Nogues only, not with Apple Inc. Apple has no obligation to furnish maintenance or support for the App. To the maximum extent permitted by law, Apple has no warranty obligation with respect to the App. Apple is not responsible for addressing claims relating to the App or your possession or use of it, including product liability, legal or regulatory failure, or consumer protection claims. Apple is a third-party beneficiary of these Terms and may enforce them against you.
